Abstract

The article analyzes a kind of international tax planning, the treaty shopping. Analyzes cases of Comparative Law, especially the “Indofood case”, originated in decisions of Indonesia and the United Kingdom, and the “Prévost” case, originated in decisions of Canada. Adopting the treaty shopping perspective, analyzes the cases “Eagle I” and “Eagle II”, from Brazilian Administrative Court (“Conselho Administrativo de Recursos Fiscais - Carf”).
