Juridical Nature of Brazilian Extrajudicial Services Emoluments

The exercise of extrajudicial activity in Brasil involves both public and private juridical regims, defining itself not as a public service, but as a public function of its own. This difference is transported to the counterpart of notaries and registrations officers, who are remunerated with emoluments, a peculiar tributary specie that has its own characteristics. These differentials that separate the emoluments from the closest specie, the tax, which directly reflects on the theorization of the tributary species, especially about the pentapartite theory.
