ICMS’ TAX INCENTIVES AND ENVIROMENT SELECTIVITY

This article intends to analyse the application of the constitutional principle of selectivity (art. 155, paragraph 2, item III) in ICMS from an environmental sight. In this order, first its analysis extrafiscality in ICMS and competitive neutrality, and then analyzes the different perspectives of the essentiality. In conclusion, it proceeds na analisy of Convênio n. 100/1997, object of Ação Direta de Inconstitucionalidade (ADI) n. 5.553 / DF, in purpose to show some theoretical guidelines, in order to contribute to the debate on a topic so relevant to the tax policy of the States and the Federal District.
