Abstract

The purpose of this article is to demonstrate the jurisprudential evolution of the Federal Supreme Court – STF and the Superior Court of Justice – STJ precedents on the subject of the incidence of Income Tax on claimed indemnifications, focusing on the identification of common points and the critical analysis of consistency of the decisions.
