It is a fact that cryptocurrencies are on their way to consolidating themselves into a prominent role in the world economic order. However, given the obstacles to understanding the legal nature of such an innovative asset, there are many challenges in developing an appropriate legislative framework to regulate them. The matter finds special relevance in Tax Law, which with its categories of incidence hypothesis, finds it difficult to regulate the taxation of an asset endowed with such fluid and complex characteristics. In view of this scenario, the present work intends to contribute to the study of the taxation of cryptocurrencies, especially regarding the incidence of the Income Tax on these assets.
