Abstract

This work examines the public agente liability as administrative agente. The author comments a Federal Supreme Court precedent about the personal liability of the public agent. He refuses any eventual change of the court position about this issue. He aims to distinguish political agent and administrative agent. Finally, he proposes the public agent liability for damages against the taxpayer rights.
